Description

In this course the most important intellectual property rights will be discussed, such as patent law, copyright law, trademark law and design protection. These rights will be dealt with, both on the European and global scale. This means that we will study not only EC Directives and Regulations, but also global treaties and regulations such as the Paris Convention for the protection of industrial property and the TRIPS Agreement of the WTO.

The object of this course is to make the students familiar with the most important aspects of IP rights on a European and global scale.

Achievement levels

  1. At the end of this course you have learned which are the most important (international) regulations regarding intellectual property law and how they are related to each other; you also know where to find these regulations

  2. You are able to make a distinction between the respective intellectual property rights, not only as regards the conditions for protection but also as regards the scope of protection, and you know the most important similarities and differences between those rights; as a result you are also able to analyse whether a specific intellectual property right can be used in a particular situation and whether or not in that situation also other intellectual property rights can be used at the same time

  3. You are able to analyse the legislation, case law and literature in the field of international intellectual property law and to analyse and solve, as if you were a lawyer working in this field of law, rather complicated cases, taken from everyday practice; it also means that you are able to read and understand national and international handbooks and scientific articles, government reports etc. with regard to this field of law

  4. You are able to write a scientific paper on a topic of intellectual property law, alone or in cooperation with other students

Assessment method

Examination form(s)

  • Paper to be written during the course (counting for 20 per cent of the final result)

  • Written examination at the end of the course (counting for 80 per cent of the final result)

  • If a student has not passed the course by the end of the academic year, any partial grades for paper or exam are no longer valid.
